Maldives Yacht Hub is an independent brokerage intermediary. We do not own, operate, crew, insure, or maintain any vessel. All vessels featured through this service are independently owned by third-party principals.
These Terms of Service (“Terms”) govern your use of the website at www.maldivesyachthub.com and your engagement of the brokerage services offered by Maldives Yacht Hub (“we”, “us”, “our”). These Terms constitute a legally binding agreement between you (“Client”, “you”) and Maldives Yacht Hub.
These Terms should be read alongside our Privacy Policy. Where a separately executed Charter Agreement or Sales Agreement exists, that agreement governs the specific transaction and prevails over these Terms to the extent of any conflict.
Maldives Yacht Hub operates as an independent brokerage intermediary. We connect clients seeking yacht charter and purchase opportunities with vessel owners, operators, and management companies (“Principals”). We act as an agent on behalf of disclosed Principals.
Maldives Yacht Hub does not own any vessel, fleet, or maritime asset. Every vessel featured on this Site, in any quotation, or in any proposal we provide is independently owned and operated by a third-party Principal. We exercise no operational control over any vessel at any time.
Our role is to facilitate introductions between clients and Principals, to assist in negotiating and documenting charter terms, to provide itinerary guidance, and to support the practical coordination of bookings. We do not act as carrier, operator, insurer, or guarantor in respect of any vessel, voyage, or service.
In order to perform this role, we will share your personal details with the relevant vessel owner, operator, charter manager, resort partner, or other service provider required to handle and fulfil your request. This includes your name, contact details, and the specifics of your enquiry. This sharing is a core and necessary function of the brokerage service. By submitting an enquiry or engaging our services, you acknowledge and agree that your details will be passed to the relevant third parties for this purpose. Full details of what we share and with whom are set out in our Privacy Policy.
Maldives Yacht Hub is remunerated by Principals through a commission on successfully completed charter bookings and sales transactions. This commission is typically incorporated within the charter rate or sale price presented to you and does not constitute a separate charge unless explicitly stated in writing. By engaging our services, you acknowledge and accept this arrangement.
Our receipt of commission does not affect our commitment to acting in good faith in your interests. We will not recommend a vessel we consider unsuitable for your stated requirements.
In providing our brokerage service, we may introduce you to or facilitate bookings with third-party providers including domestic aviation and seaplane operators, resort and hotel partners, dive operators, water sports providers, and ground and marine transfer companies (collectively “Third-Party Providers”).
Maldives Yacht Hub acts solely as an introducer in respect of Third-Party Provider services. All services delivered by Third-Party Providers are subject exclusively to that provider’s own terms, conditions, and policies. Maldives Yacht Hub accepts no responsibility or liability of any kind for the quality, safety, timeliness, accuracy, or availability of services provided by any Third-Party Provider, even where we facilitated the introduction or assisted with the booking. You are strongly advised to review the terms of any Third-Party Provider before confirming a booking with them.
Every vessel made available through Maldives Yacht Hub is owned and operated exclusively by an independent third-party Principal. Maldives Yacht Hub has no ownership interest in any vessel and bears no responsibility for the operation, management, maintenance, crewing, safety systems, classification, survey, insurance, or flag state compliance of any vessel.
These matters are entirely the responsibility of the Principal. Clients are encouraged to request confirmation of a vessel’s certification, insurance status, and operational permits from the Principal directly prior to confirming any booking.
Vessel specifications, technical data, capacity details, photographs, video content, and descriptive text featured on this Site are provided by and are the sole responsibility of the relevant Principal. We take reasonable care in presenting this information but do not independently verify all technical specifications, conduct physical surveys of every listed vessel, or guarantee the accuracy or completeness of any listing.
Photographs and images are for illustrative purposes only. Minor differences between images and the actual presentation of a vessel are normal and do not constitute misrepresentation.
Maldives Yacht Hub accepts no liability for any loss, personal injury, illness, death, damage to property, or adverse experience of any nature arising from or connected to: the physical condition, seaworthiness, or mechanical state of any vessel; the competence, conduct, or negligence of any vessel crew member or Principal; any accident, incident, or emergency occurring on board or in connection with any vessel; or any deviation from a planned itinerary arising from weather, sea conditions, or vessel performance.
Your contractual relationship in respect of the charter or use of any vessel is directly with the Principal. All vessel-related complaints, claims, and disputes should be directed to the Principal. We will provide reasonable assistance in facilitating communications but are not a party to the underlying charter or sales contract.
Submitting an enquiry through this Site, whether by online form, email, or telephone, does not constitute a reservation, booking, or binding commitment of any kind. All enquiries are expressions of interest only. Vessel availability and pricing remain subject to change without notice until a booking is formally confirmed.
Any quotation we provide is indicative and is valid for the period stated within it, or where no period is stated, for 48 hours from the time of issue. Quotations are subject to vessel availability and Principal confirmation and may be revised or withdrawn prior to booking confirmation.
A confirmed booking exists only when all of the following have occurred:
Until these conditions are all satisfied, no legal obligation to proceed exists on any party and vessel availability is not guaranteed.
The base charter rate typically covers use of the vessel and permanent crew during the agreed charter period. Unless expressly stated otherwise in the Charter Agreement, the following are not included in the base rate and are charged as additional expenses, typically as an Advanced Provisioning Allowance (APA):
A full itemised breakdown of what is included and excluded will be set out in the Charter Agreement prior to booking confirmation.
Prices are quoted in United States Dollars (USD) unless otherwise stated. Applicable taxes, including Maldivian Goods and Services Tax (GST) on tourism services, will be identified in the Charter Agreement. We accept no responsibility for currency fluctuations between quotation and payment dates.
Cancellation charges are determined by the Principal and set out in the Charter Agreement. Charges typically increase as the departure date approaches. As a general guide, industry standard terms for Maldives yacht charters may provide for loss of deposit on cancellation more than 90 days before departure, rising to 100% of the charter fee for cancellations within 30 days. The binding terms are those in your specific Charter Agreement.
We strongly recommend that all clients obtain comprehensive travel and trip cancellation insurance before booking confirmation.
In the event that a Principal cancels a confirmed charter due to mechanical failure, safety concerns, or regulatory issues, the Principal is responsible for any refund or remediation in accordance with the Charter Agreement. We will assist in identifying alternatives but are not financially liable for Principal-initiated cancellations.
Neither Maldives Yacht Hub nor any Principal shall be liable for failure or delay in performance caused by circumstances beyond reasonable control, including acts of God, extreme weather, seismic or tsunami events, government action, travel restrictions, port closures, public health emergencies, civil unrest, or failure of critical infrastructure. In such circumstances we will use all reasonable efforts to assist in identifying alternative arrangements.
By engaging our services and boarding any vessel arranged through us, you agree to:
The vessel Master retains absolute authority over the vessel and all persons on board at all times. The Master may refuse boarding or require disembarkation of any person whose conduct poses a safety risk. No refund or compensation is due in such circumstances.
Maldives Yacht Hub excludes all liability to the fullest extent permitted by applicable law for any loss, injury, illness, death, property damage, or adverse experience arising from: the condition or seaworthiness of any vessel; the acts or omissions of any Principal, Master, or crew member; the cancellation or modification of any voyage by a Principal; adverse weather or sea conditions; or any accident or incident occurring on board any vessel.
Maldives Yacht Hub excludes all liability for loss, injury, or adverse experience arising from services provided by Third-Party Providers introduced through us, including aviation operators, resort partners, dive operators, and transfer services. All such providers operate under their own independent terms and conditions.
To the fullest extent permitted by law, Maldives Yacht Hub’s total aggregate liability to you for any claim arising from these Terms or your use of this Site shall not exceed the total commission actually received by Maldives Yacht Hub in connection with the specific transaction giving rise to the claim. Where no booking has been confirmed, liability is limited to USD 500 in aggregate.
In no event shall Maldives Yacht Hub be liable for any indirect, consequential, special, or economic loss, including loss of enjoyment, loss of anticipated savings, or loss of opportunity, whether or not we have been advised of the possibility of such losses.
You agree to indemnify and hold harmless Maldives Yacht Hub and its representatives from any claim, loss, damage, or liability (including reasonable legal costs) arising from your breach of these Terms, your breach of any Charter Agreement, your conduct on board any vessel, or any claim by a third party arising from your actions in connection with any service arranged through us.
All content on this Site, including text, photographs, video, vessel descriptions, itineraries, destination guides, logos, and design elements, is the property of Maldives Yacht Hub or its licensors. You may view and print content for personal, non-commercial use only. You may not reproduce, republish, scrape, or commercially exploit any content from this Site without our prior written consent.
Photographs and videos displayed on this Site are used with the permission of the relevant vessel owners, operators, photographers, and content creators, or are used in good faith on the basis of fair use principles where applicable. Visual content featuring specific vessels remains the property of the respective vessel owner or their appointed photographer.
If you are a photographer, videographer, vessel owner, or rights holder and believe that any image or video on this Site has been used without proper authorisation, or if you wish to request removal of any visual content for any reason, please contact us at info@maldivesyachthub.com with the subject line “Content Removal Request”, including the URL of the relevant page and a description of your rights in respect of the content. We will review all such requests promptly and remove or replace content where a valid claim is established. We aim to respond to all takedown requests within 5 business days of receipt. We have no interest in retaining content where the rights holder has objected to its use.
Yacht charter operations in the Maldives are regulated under the Maldives Tourism Act (Law No. 2/1999, as amended) and regulations issued by the Ministry of Tourism. All vessels offered for charter in Maldivian waters are required to hold valid tourism operational permits and to comply with applicable vessel safety and crew certification requirements. These obligations rest entirely with the Principal as vessel owner and operator. Clients may request confirmation of a vessel’s permit status directly from the Principal before confirming any booking.
All charter operations in Maldivian waters are subject to Maldivian maritime law and the regulations of the Maldives Transport Authority. The vessel Master is the competent authority on board at all times.
The Maldives enforces strict environmental protection rules including marine protected area restrictions, coral reef preservation requirements, and special regulations applicable to UNESCO Biosphere Reserve areas such as Baa Atoll. Access to certain areas is restricted or requires a permit. Compliance with all environmental rules is the responsibility of the Principal. Clients are expected to cooperate fully, including with any restrictions on anchoring, diving, fishing, and waste disposal.
All persons joining any vessel arranged through us are solely responsible for holding valid travel documentation, applicable visas, and complying with Maldivian entry and customs requirements. We accept no liability for any loss arising from failure to meet immigration or customs requirements.
We may update these Terms at any time. Revised Terms will be published on this Site with an updated effective date. Your continued use of the Site after publication constitutes acceptance. Where changes materially affect a confirmed booking, we will endeavour to notify you directly.
These Terms are governed by the laws of the Republic of Maldives. Any dispute arising from these Terms or your use of this Site shall be subject to the jurisdiction of the courts of the Republic of Maldives. Where you are a consumer in a jurisdiction that confers mandatory protections, nothing in these Terms limits those rights to the extent limitation is prohibited by applicable law.
Where a dispute cannot be resolved through direct communication, the parties agree to attempt good-faith mediation before commencing formal legal proceedings.
If any provision of these Terms is found to be invalid or unenforceable, it shall be severed to the minimum necessary extent and the remaining provisions shall continue in full force. These Terms, together with our Privacy Policy and any executed Charter Agreement, constitute the entire agreement between the parties on the subject matter hereof.
